Practice Areas
Rosemary works in the firm’s Litigation group. She is experienced in trial and appellate actions in state and federal courts in areas ranging from healthcare to banking, high technology, toxics, student loans and real estate involving issues of guaranties, arbitration, trade secrets, antitrust, intellectual property, securities and unfair business practices.
In recent years, Rosemary has dealt with many of the critical healthcare issues facing the medical profession. Rosemary has represented doctors in fee negotiations, actions against Medi-Cal managed care organizations in price fixing claims and peer review. She has represented hospitals in breach of contract actions and advised doctors groups on antitrust and integration issues, reimbursements, EMTALA and credentialing issues.
In the area of banking, Rosemary has represented banks and other financial institutions on issues involving student loans, lender liability, agriculture, guaranties, construction, real estate, embezzlement, Articles 3 and 4 of the UCC, trade secrets, forged endorsements, bankruptcy, receiverships, antitrust, class actions and unfair business practices.
Rosemary has been involved in a successful accountancy malpractice lawsuit involving mortgage loan warehousing, successfully defended a NYSE company against the California State Lottery relating to automating the Lottery, and litigated an action relating to Indian tribal lands. Rosemary also has extensive experience writing writs and appeals.
Rosemary’s professional experience is supplemented by her participation in various panels and through publication of articles. She has taught for the National Institute of Trial Advocacy, has been a panelist in a discussion on CyberTrials at the 1995 U.S. Eastern District federal court conference, has spoken on provider deselection in the health care industry to the California Judges Conference and the American Health Lawyers Association, and has served as a CEB panelist on mediation.
