Practice Areas

Dale is a shareholder in the firm’s Litigation and Intellectual Property groups. Dale has a broad range of litigation experience in all areas of business, intellectual property and real estate litigation. He has tried over forty jury trials to conclusion and has had numerous court trials and binding arbitrations since his admission to practice law in 1981. Recently, Dale's practice has focused on litigation involving emerging and technology related companies, including cases involving copyright and trademark infringement, patent rights, securities litigation, technology licensing rights, statutory unfair business practices, minority shareholder claims, stock option disputes and distributorship disputes.

Dale's general business litigation experience has included cases involving breach of contract, fraud, accountant liability, securities litigation franchisor/franchisee disputes, shareholder derivative actions, partnership dissolutions and accountings, termination of distributorships, wrongful termination and performance bond claims.

Dale also developed extensive experience in all areas of real estate litigation, including land sale contracts, limited partnership disputes, commercial landlord/tenant disputes, boundary and easement disputes, real estate investment fraud and environmental and hazardous waste litigation. Dale's environmental litigation experience has included cases involving soil and groundwater enforcement, remediation and cost recovery actions under CERCLA and RCRA, California State environmental statutes and common law. He has also represented clients concerning landfill closure requirements and air quality compliance issues, including claims of personal injury allegedly caused by the air emissions.

Dale has lectured before various trade association groups, continuing legal education courses, entrepreneurial associations, real estate developers, real property managers, lenders and environmental consultants. Topics discussed and materials presented on these occasions include a variety of issues concerning intellectual property litigation, commercial damages, valuation of intellectual property, soil and groundwater contamination, Proposition 65 compliance, preacquisition site assessments, and professional liability.
