WT Wins: After Issuance of TRO and Injunction, Weintraub Negotiates Favorable Settlement and Obtains Judgment in Trade Secret Case

Weintraub’s client, the exclusive distributor of a product, discovered that two of its two former employees who had been involved in selling and bidding on jobs to install the product, had, prior to their departure, taken company trade secret information including customer lists and strategic information relating to the client’s future project pipeline, and had set up a competing business. The U.S. District Court for the District of Nevada issued a TRO in favor of our client and the product manufacturer, and then granted, in significant part, our request for a preliminary injunction, over the opposition of defendants’ counsel. Shauna Correia then spearheaded the negotiation of a favorable settlement with the defendants (former employees, their business partner, and the competing businesses). Although settlement terms are confidential, the defendants stipulated to entry of a judgment prohibiting their use of the stolen trade secrets and prohibiting them from bidding against our client on more than a dozen upcoming projects on our client’s target project list, and the court entered the order granting the judgment on July 22, 2021.
