WT Win: Shauna Correia and Tomiwa Aina Succeed in Dismissal of Defamation Case

On September 20, 2024, Shauna Correia and Tomiwa Aina obtained dismissal of a defamation case brought by a physician against a private retirement home and four individuals from its administrative team.

After the physician was accused by the Attorney General of negligence resulting in the death of one of the facility’s residents, the physician’s contract was terminated. The physician claimed the administrative staff told residents and the public that she was not competent and discouraged potential patients from using her services. The Santa Clara Superior Court granted our clients’ Special Motion to Strike (anti-SLAPP), ruling that the alleged speech was constitutionally protected and ordered the case dismissed.
