Workplace Complaints: Steps to Insure an Impartial and Defensible Investigation

Join Weintraub Tobin employment attorneys and AWI-trained investigators, Lizbeth (Beth) West and Meagan Bainbridge, for an engaging and interactive seminar where they will discuss an employer’s obligation to conduct an impartial investigation into complaints of workplace misconduct.

Beth and Meagan will walk attendees through a hypothetical investigation, where a “Star” employee has just been accused of harassing two employees. Leadership loves this Star employee; in fact he’s considered the best employee in his department and one of the top performers in the company. One of the complaining employees has also disclosed in her complaint that she had a previous relationship with the alleged harasser. Using this hypothetical fact pattern as a backdrop, Beth and Meagan will provide tips and best practices for conducting a fair and defensible investigation that the Company can rely on. 

A few highlights of seminar topics:

  • Factors to consider when deciding who should conduct the investigation.
  • Determining the relevant scope of the investigation.
  • Evaluating whether the company should take interim measures during the investigation.
  • Planning the investigation and gathering evidence: e.g. interviewing witnesses and reviewing relevant documents, electronic information, etc.
  • Synthesizing the evidence and making credibility assessments.
  • The hard and important step of fairly analyzing the relevant evidence from both sides and reaching reasonable findings.
  • Preparing a clear and defensible report of the investigation process and findings.

Approved for two (2.0) hours MCLE. This program will be submitted to the HR Certification Institute for review. PRE-REGISTRATION IS REQUIRED. There is no cost to attend*, and this program is only offered in-person.
