WT Wins: Construction Team Reduces Wrongfully Inflated Mechanics Lien for Client by $11.4 Million

Dustin Amrein of the Weintraub Tobin Construction Group succeeded in reducing a mechanics lien against his client, Oroville Hospital, from $16.8M to $5.4M after proving that the claimant had wrongfully inflated the lien.

The court, after a thorough review of the parties’ briefing, removed $11.4 million in improper charges from Modern Building Company and Sundt Construction Company’s (known collectively on this project as Modern-Sundt) mechanics lien against Oroville Hospital and reduced the lien to $5.3 million. The court found that the contractors wrongfully inflated their $16.8 million-dollar mechanics lien, filed in 2022, by including three years of disputed delay damages.

Dustin and the Weintraub Construction team used historical code and legislative history to help prove the wrongful inflation. With the removal of $11.4 million in improper charges, Oroville Hospital is significantly closer to completing the expansion project and providing its community with the planned additional hospital services and space.
