Annie Marcroft is an Associate in the Firm’s Litigation practice group, where she combines critical thinking and creativity to achieve results that matter most to her clients.

Annie represents businesses and individuals in a wide range of complex commercial, real property, and other civil disputes. Her practice includes complex contract and commercial disputes, real property and land use litigation, inverse condemnation, environmental matters, fraud and unfair competition claims, and shareholder disputes. Annie has litigated cases for clients in a broad range of industries, including agribusiness, real estate and land development, manufacturing and distribution, technology, mining, and professional services.

Annie has experience handling matters through all stages of litigation, from pre-suit strategy and discovery, through dispositive motions, arbitration, trial, and post-trial proceedings and appeals. Annie handles cases on behalf of both plaintiffs and defendants and has experience litigating in both state and federal court. Annie approaches each matter with an emphasis on understanding each client’s business objectives, identifying the issues that will drive the outcome, and developing a practical litigation strategy from the outset.

Before entering private practice, Annie served as a summer clerk to the Honorable L. Scott Coogler, then Chief Judge of the United States District Court for the Northern District of Alabama, and participated the Philip C, Jessup International Law Moot Court Competition.

Representative Matters:

  • Obtained a six-figure non-dischargeability judgment on grounds of actual fraud, embezzlement, and willful and malicious injury, following trial in a bankruptcy adversary proceeding, including an award of punitive damages for financial elder abuse.  
  • Represented the sole petitioning creditor in a successful involuntary Chapter 7 bankruptcy proceeding resulting in creditor’s recovery of over $1 million.
  • Represents a commercial mine operator in complex real property and land use litigation involving mining rights, reclamation obligations, contractual royalty claims, and disputes with public agencies, with several million dollars in claimed economic interests at stake.
  • Represents Mendocino Railway and Sierra Northern Railway in complex federal environmental litigation concerning alleged dioxin contamination and remediation at the former Georgia-Pacific Mill site in the City of Fort Bragg, involving CERCLA, contribution and apportionment, and inverse condemnation issues.
  • Handles complex commercial disputes for businesses in the agricultural, manufacturing, distribution, technology, professional services, and other commercial sectors involving the sale of goods, contract performance, fraud, unfair competition, and related business torts.
