Join Weintraub Tobin attorney-investigators Beth West, Meagan Bainbridge, and Nikki Mahmoudi as they guide attendees through the full investigation lifecycle, from the initial complaint through the final investigative findings. Drawing on real-world experience, the presenters will discuss best practices, common pitfalls, and practical considerations for conducting effective workplace investigations.

Seminar Overview & Learning Objectives

Participants will learn how to:

  • Select the Appropriate Investigator: Evaluate key considerations when determining who should conduct an investigation, including issues of neutrality, expertise, and potential conflicts of interest.
  • Define Scope and Develop an Investigation Plan: Establish the scope of the investigation and outline a clear investigation plan, including establishing appropriate timelines and identifying necessary witnesses and other evidence.
  • Conduct Objective and Effective Interviews: Interview complainants, respondents, and witnesses using techniques designed to gather reliable information while maintaining neutrality.
  • Assess Credibility and Evaluate Evidence: Effectively and properly use credibility factors when evaluating witness statements and documentary evidence to resolve disputed facts.
  • Prepare Thorough and Defensible Findings: Draft clear, impartial investigative reports that accurately analyze the evidence and communicate findings in a legally sound manner.
