Beth West Presents a Half-Day Workshop – Navigate Employee Leave Laws

Sacramento Business Journal reports that, “Post and fellow shareholder Beth West will present a half-day workshop on the topic Wednesday. Sponsored by the Sacramento Employer Advisory Council in partnership with the state Employment Development Department, the event will be held from 7:30 a.m. to 12:30 p.m. at the Sacramento State Alumni Center located at 6000 J St. The event costs $90 for members and $125 for nonmembers.

Summary of Program

Employees use networking sites to communicate with one another (as well as current and potential customers). They post their daily thoughts and activities, upload photos and, occasionally, adversely impact ther employers’ buusiness. What can an employer do to protect itself without intruding on employee rights?

Some of the topics to be discussed include:

  • Employer’s use of employee’s social media information versus the employee’s right to privacy.
  • Protection of employer’s Confidential and Proprietary Information.

As most employers well know, responding to the needs of an injured or ill employee is not always an easy thing to do. Employers often rack their brain over the following questions:

What are the employee’s rights?

  • What are the employer’s obligations?
  • Which laws apply to a given situation? Are they different depending on whether the injury or illness is work related or not? Are they different depending on whether or not the employee has been declared “disabled?”
  • Does a disabled employee have a right to leave or just an accommodation on the job?
  • If the employee does needs time off from work, is it paid or unpaid and how much “disability” leave can they get?
  • What do California’s State Disability Insurance (SDI) and Paid Family Leave (PFL) programs provide to employees who need time off from work?
  • What obligations does the employer have to assist employees in obtaining SDI and/or PFL benefits?
  • What can the EDD do to help an employer and an employee understand the SDI/PFL claim process?

Accommodating Employees: It’s Even More Complicated!

Most employers know that employees may need to be accommodated from time to time for various reasons. Often this is because of an employee’s disability or medical condition. It is important for employers to understand and comply with how the courts and various federal and state regulatory agencies define accommodations, as well as learn what their rights and obligations are regarding: (1) engaging in the interactive process; and (2) providing reasonable accommodations.

Program Highlights

This interactive seminar will provide an overview of the many accommodations employers and HR professionals may be forced to consider, who should be accommodated, and how to engage in an interactive process to determine an appropriate accommodation. Pay Deductions Explained: What You Can and Can’t Deduct from Employees’ Pay

Summary of Webinar
Pay withheld from employee earnings typically includes income tax, health insurance, and social security contributions, but there are many other areas that may cause confusion for even the savviest HR manager. The Fair Labor Standards Act (“FLSA”) permits employers to deduct the reasonable cost of some items, even if the employee’s earnings drop below the minimum wage such as meals and lodging, employer-provided transportation, instructional costs like tuition, and deductions that benefit the employee.
