WT Wins: David A. Diepenbrock Instrumental In Helping Client Secure $58.5 Million Settlement

On October 4, 2023, Sacramento County settled a long-running civil rights lawsuit brought by Hardesty Sand & Gravel for $58.5 million. The landmark settlement falls on the heels of a $20 million settlement in a related suit brought by the owners of the ranch where Hardesty Sand & Gravel had mined for decades until Sacramento County unlawfully ordered Hardesty to shutter the mining operation.

WT Wins: Paul Gaspari and Ryan Abernethy Secure Final Demurrer in Consumer Class-Action Lawsuit

On November 8, 2023, Paul Gaspari and Ryan Abernethy secured their third and final demurrer as to all causes of action in a consumer class action that was brought on behalf of all those who purchased services from our client since 2003. The court found that the complaint failed to articulate a cognizable theory of liability that could be brought on a class-wide basis because the alleged injury was too theoretical, the plaintiffs failed to establish a class-wide fiduciary or confidential relationship, and individualized inquiries would dominate the fraud-related class claims. The Court sustained the demurrer without leave to amend.   

Weintraub Supports Hope Cooperative’s 11th Annual Stand Up Sacramento Comedy Fundraiser

On November 2nd, Hope Cooperative hosted its 11th Annual Stand Up Sacramento Comedy Fundraiser, benefitting individuals and families experiencing mental health and homelessness challenges in the Sacramento area. Weintraub Tobin shareholder Lizbeth “Beth” West, who serves as the organization’s Board President, addressed attendees. The Firm was also a proud sponsor of the event.
